These General Terms and Conditions of Sale apply to the purchase of Mondia Swiss brand products, made remotely via the Internet on the website "www.mondiaswiss.com," a trademark owned by Diffusione Orologi srl, with headquarters at Via Santa Maria a Valle no. 4 – 20123 Milan. These purchases are reserved for direct user customers. Each purchase transaction will be governed by the provisions of Legislative Decree 185/99 and, with regard to privacy protection, will be subject to the provisions of Legislative Decree no. 196/03.
ACCEPTANCE OF THE ORDER / CONCLUSION OF THE CONTRACT
When the Customer places an online order for the products he has placed in the cart, he agrees to purchase them at the price and under the terms indicated in these General Conditions of Sale.
Diffusioneorologi will not accept orders:
– if the material is not available in stock at the time of ordering (if the material is not available, it will not be possible to add it to the cart) and/or
– if the Customer's credit card issuer does not confirm the payment.
Diffusioneorologi reserves the right to refuse an order at its sole discretion.
CUSTOMER COMMITMENTS
These General Conditions of Sale must be reviewed online by Customers before placing their orders. Placing an order therefore implies their full knowledge and acceptance.
The Customer undertakes and undertakes, once the online purchase procedure has been completed, to print and keep these general conditions of sale, already viewed and accepted during the purchase process, in order to fully satisfy the conditions set forth in Articles 3 and 4 of Legislative Decree no. 185/1999.
PRICES
All prices on the site include VAT.
The prices listed on this website are the current sales prices. If DIFFUSIONEOROLOGI clearly misstates the price of the ordered goods, the order may be cancelled at any time by DIFFUSIONEOROLOGI or the Customer, provided this is done before the goods are shipped, and the products may be reordered at the correct selling price.
PAYMENTS
Payment for purchased products and related shipping costs must be made by the customer when placing the order using one of the available credit cards listed online or by cash on delivery. DIFFUSIONEOROLOGI is not responsible for any fraudulent or unlawful use of credit cards by third parties when paying for purchased products.
DELIVERIES
In case of acceptance of the order, it is specified that:
– for orders accepted on the site before 1pm on a working day, the goods will normally be shipped within the following 72 hours;
– for orders received after 1pm, these will be processed the next working day and therefore the 72 hours become 96 hours from the order;
– If the order was placed on a non-working day, the order will still be shipped within 96 hours of the next working day.
Exceptions may apply in the event of Force Majeure Events.
The goods will be delivered to your home via GLS (or DHL, SDA) express courier.
Shipping means delivering the goods to the courier.
The delivery times described during the purchase process on the website depend on the shipping method used and the destination of the goods. They depend on the weight and size of the items purchased. The courier will deliver the goods only upon receipt of a signature.
If the goods, shipped via courier, do not arrive within the established time frame, the Customer must contact DIFFUSIONEOROLOGI at the number indicated on this site.
If the goods are not delivered due to the Customer's inability to receive them, the Customer must first contact the courier using the contact information provided by the courier for non-delivery of the goods. If this is not possible, the customer service toll-free number listed on this website must be contacted.
LIABILITY FOR LATE DELIVERY
If the goods are not shipped within the agreed timeframe or the courier fails to deliver the goods within the expected delivery times, DIFFUSIONEOROLOGI will contact the Customer as soon as possible and, based on the latter's needs, will attempt to establish another delivery date.
If an agreement cannot be reached, DIFFUSIONEOROLOGI will refund the Customer the full amount paid.
RIGHT OF WITHDRAWAL
To exercise this right, the customer must contact the customer service team listed on the website, follow the instructions provided by the operator, and send DIFFUSIONEOROLOGI a notification to this effect within 7 business days of receiving the goods. This notification must be sent by registered letter with acknowledgement of receipt, or by telegram, fax, or email, always sent within the aforementioned 7-day period and followed by a confirmation sent by registered letter with acknowledgement of receipt within the following 48 hours (if sending an email, simply wait for a response).
Once we receive the aforementioned notice of withdrawal, DIFFUSIONEOROLOGI will promptly inform the customer of the details on how to return the goods.
IMPORTANT:
As the only burden, and if the error is not due to an event attributable to DIFFUSIONEOROLOGI, the Customer will have to bear the costs of returning the goods.
The goods must be returned intact and in their original packaging, complete with all their parts and without having suffered any damage.
Upon arrival at the warehouse, the goods will be examined and, in the presence of damage or tampering, the right of withdrawal cannot be exercised.
DIFFUSIONEOROLOGI will refund the customer the full amount already paid within the legal deadlines. The refund will be made by crediting the amount due to the credit card used by the customer for the purchase being refunded.
It will be the Customer's responsibility to promptly provide DIFFUSIONEOROLOGI with any information necessary for a correct and prompt refund procedure.
COMPLAINTS
Any complaints must be addressed directly to DIFFUSIONEOROLOGI, by contacting customer service or by emailing the dedicated address indicated on the website. DIFFUSIONEOROLOGI undertakes to respond to complaints within three working days.
APPLICABLE LAW AND JURISDICTION
The sales contract between the Customer and DIFFUSIONEOROLOGI is deemed to have been concluded in Italy and is governed by Italian law. Any dispute concerning the validity, interpretation, or performance of this contract shall be subject to the jurisdiction of the courts of the consumer's place of residence or domicile, if located within Italy.
DELIVERY OF ONLINE PURCHASE
Online purchases are shipped and delivered within 7 days throughout Italy via GLS express courier (or DHL, SDA) from Monday to Friday, 9:00 am to 6:00 pm. All orders received are processed and shipped as soon as possible after credit card payment has been authorized and, of course, subject to stock availability.
